TERMS AND CONDITIONS FOR SEVAMRUTAM APP:

This document is an electronic record in terms of the Information Technology Act, 2000 and rules thereunder pertaining to electronic records as applicable and amended. This electronic record is generated by a computer system and does not require any physical or digital signatures. This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries Guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and the terms and conditions for access or usage of SEVAMRUTAM Android Mobile Application.
PLEASE READ THE FOLLOWING TERMS AND CONDITIONS VERY CAREFULLY BEFORE USING THE MOBILE APPLICATION. ACCESSING, BROWSING OR OTHERWISE USING THE APPLICATION IMPLIES YOUR AGREEMENT TO BE BOUND BY ALL THESE TERMS AND CONDITIONS ("Agreement"). If you do not want to be bound by the Terms and Conditions, you must not use the Mobile Application or Services. In these Terms, references to "SEVAMRUTAM USERS" shall mean the end user accessing the Application, its contents or using the Services offered. SEVAMRUTAM USERS also include persons such as General Users (Devotees) or Bearers(Temple Bearers). The terms "You" and "User" shall be interchangeably used for "SEVAMRUTAM USERS". "SEVAMRUTAM Services" means a collective reference to the Seva management features provided by a portal company.

Eligibility :

A)SEVAMRUTAM users and rights of admission is reserved solely for :
I. Indian Nationals.
II. Persons of Indian Origin (PIO).
III. Non Resident Indians (NRI).
IV. Persons of Indian Descent or Indian Heritage
B) Further in capacity as user you confirm that you are :
I. Temple Administrator / Temple Bearer/Common man who manages a religious organization.
II. If you have interest in Temple Administration, then register to the app.

Registration

1. We expect that you would complete the online registration process with fairness and honesty in furnishing true, accurate, current, complete information and with providing recent data of you which will help you to meet your parameters. We expect you to read the relevant column before keying in the details or selecting the option available or uploading the photo. You are requested not to key in details of the field other than the applicable field (including mentioning id's of other platforms/websites/App or repeating your details in other fields, after filling them once in the relevant fields or other details and photographs if required.
2. SEVAMRUTAM reserves the right to block/Suspend the registration of your registration as auser on Website/App, if any, in the case of your contact details/links being entered in irrelevant fields or if there are errors in any data entered in their personal information asked by App.
3. Registration of duplicate/Fake/Bogus profiles of the same person is not allowed in Website/App. SEVAMRUTAM shall have full right to suspend or terminate (without any notice) such duplicate users.
4. You acknowledge and confirm that your registration with SEVAMRUTAM and the usage of application services is with the bonafide intention of seva management ctivities and not otherwise. Religious Organizations can become users of SEVAMRUTAM and use the service or users data only for seva management purpose,not for any other illegal activities/data sharing business. SEVAMRUTAM reserves its right to initiate appropriate legal action for breach of these obligations.

Account Security

You are responsible for safeguarding the confidentiality of your login credentials such as your user id, password, OTP, etc., and for restricting access to your computer/mobile to prevent unauthorized access to your account. We, as a service provider do not ask for Password and you are cautioned not to share your password to any persons.. You agree to accept responsibility for all activities that occur under your account.

Role & Responsibilities of SEVAMRUTAM

SEVAMRUTAM reproduces your details once you register on our Mobile Application on "as is as available" basis and also share your Registration details with other registered users within App. SEVAMRUTAM obligation is only to provide an interface to its registered users to manage seva in a religious organization for their prospects themselves without any assistance.
SEVAMRUTAM does not prohibit any users from trading /contacting you based on their trading preference.
SEVAMRUTAM cannot 100% guarantee or assume responsibility for any specific results from the use of the data available from the service.
SEVAMRUTAM cannot guarantee the complete protection of user data while it is in transit, or prevent any tampering of the data by a third party with malicious intent before the data reaches the servers.
SEVAMRUTAM does not authenticate/endorse any information of any registered users and hence you as a user need to verify the credentials and information provided by other users.

Role & Responsibilities of registered Users.

For safeguard your information by creating a strong password during User creation(Login) with combination of alphabets, both upper and lower case and numbers.
Using abusive language when communicating with the other users, being discriminative or using racial comments, violating any law for the time being in force. we are not responsible for legal actions.
Users agree to use secure devices, software and networks in a private place for accessing the services.
Users shall not use any kind of Bots like web robots, Chatbot or any other automated processes/programs/scripts to use, communicate or respond in App.

Privacy of Users

To protect your privacy and understand our practices as amended from time to time , please read and follow our Privacy Policy which also governs your visit to SEVAMRUTAM, the personal information / data provided to us by you during the course of usage of application will be treated as confidential and in accordance with the Privacy policy and applicable laws and regulations. If you object to your information being transferred or used, please do not use the App.

Disputes between Users (Vendor-Sellers)

SEVAMRUTAM Users are solely responsible for the communications (through any medium) with prospect or vice versa. SEVAMRUTAM expressly disclaims any responsibility or liability for any monetary transaction(s) or exchange(s) or interaction(s) or passing of information(s) etc. between any users inter se via e-mail, chat, interaction, Whatsapp or any other medium of communication between members either using App or otherwise.
SEVAMRUTAM has no obligation, to monitor any such disputes arising between the Seller and Vendor, and SEVAMRUTAM shall not be party to any such dispute/litigation etc.
SEVAMRUTAM is not a broker or the agent of any Users(Vendor/Seller), and SEVAMRUTAM does not partake in the exchange of any kind of discussion between the users and prospects or the results of their discussion.

Third Party Website/Applications

SEVAMRUTAM users understand and agree that Application may allow third parties to put up advertisements on the application and does not control the contents of such third party advertisement on the SEVAMRUTAM app. Third party websites/app to which links are given on Website/App are not governed by these Terms and conditions and all such third party websites are governed by their own terms and conditions for use and privacy policy, and in case of conflict the terms and conditions of the third party website shall prevail. The Company does not in any manner whatsoever authenticate, endorse, verify or certify these third party websites or any contents therein. Please note that a user shall click on links to third party websites at his / her sole risk and responsibility.
SEVAMRUTAM reserves the right to add/delete/alter/modify/suspend any or all the Services at any time as it may deem fit, without notice. The members are expected to see the change on the Website/App.

Disclaimer

Your access to and use of the SEVAMRUTAM Services or any content is at your own risk. YOU UNDERSTAND AND AGREE THAT THE SERVICES ARE PROVIDED TO YOU ON AN "AS IS" AND "AS AVAILABLE" BASIS. WITHOUT LIMITING THE FOREGOING, TO THE FULL EXTENT PERMITTED BY LAW, SEVAMRUTAM does not warrant that the App, its servers, or e-mail sent from Applications are free of viruses or other harmful components. SEVAMRUTAM will not be liable for any damages of any kind arising from the use of this Website/App, including, but not limited to direct, indirect, incidental, punitive, and consequential damages.
SEVAMRUTAM shall not be liable for the outcome of any interaction in a meeting, call, sms, chat, email or social media posts at any point of time
You expressly agree that your use of this Website/App is at your sole risk.

Indemnity

By using our SEVAMRUTAM services you agree to defend, indemnify, and hold harmless SEVAMRUTAM, its subsidiaries, affiliates, Directors, officers, agents, and other partners and employees, fully indemnified and harmless from any loss, damage, liability, claim, or demand, including reasonable attorney's fees, made by any person through improper use of the service provided by SEVAMRUTAM. This defence and indemnification obligation will survive in perpetuity.

Termination

1. We SEVAMRUTAM in good faith reserve our right to terminate your Registration or suspend/delete your login details at our sole discretion without any notice to you and take any action as mentioned above the Terms and Conditions, in case you,
have provided incorrect information on our App
have committed any fraudulent/ unlawful/ illegal activities through the use of our App
Have obey the Indian constitutional laws
Have unfollowing the trading policies by nation
If got any legal complaint from authorized institutions
have violated any of these Terms and conditions.
2. have misappropriated the name, likeness, email address, contact no or other personally identifiable information of another users created a registered on our App by impersonation/ fake/ bogus/ false/ misrepresentation/ without consent of the person.
3. If SEVAMRUTAM receives any complaint against you and consequently we have suspended/deleted your profile in good faith, then we shall not be liable to you in any manner whatsoever, including for any loss, costs, expenses, or consequence, if any.
4. Users will remove/block, if any abusive things are reported, and it will be verified.
5. All provisions of these terms and conditions that by their nature should survive termination shall survive termination, including, without limitation, disclaimers, and limitations of liability. Termination of your access to and use of the Services shall not relieve you of any obligations arising or accruing prior to such termination.

Mode of Payment

1. All payments shall be by way of /Credit/Debit Cards/Netbanking/mobile wallets/UPI with the prevailing RBI guidelines. Activation of paid SEVAMRUTAM service shall be subject to realization of the said payment. In case of dishonor happens in payment system Further SEVAMRUTAM service to your account will be deactivated / suspended until you settle the value of the payment and applicable bank charges.
2. SEVAMRUTAM uses third party payment gateways for collection of credit/debit card or other payment instruments. In case of payment gateway failure, the same would be communicated to the SEVAMRUTAM member by the payment gateway provider. SEVAMRUTAM shall not be responsible for Extra currency/conversion charges/deductions/error issues from the payment gateway. In the case of failed online transactions, which result in no services, SEVAMRUTAM offers no guarantees whatsoever for the accuracy or timeliness of the refunds reaching the Customers card/bank accounts through the payment gateway.
3. You agree to provide us with your Permanent Account Number / Form 60/61 of the Income Tax Act, 1961 and rules thereunder in the event you choose any paid package of SEVAMRUTAM, the value of such paid package being Rs.2,00,000/- [Rupees Two Lakh Only] and above from SEVAMRUTAM.

Renewal

1. Every SEVAMRUTAM paid package(if any) users can renew the paid package to carry forward the un-used contacts.
2. The payments made by SEVAMRUTAM users by way of registration / membership / renewal fee / plans , auto renewal are treated as non-refundable. Payment once made for SEVAMRUTAM services cannot be assigned to any person/party or adjusted towards any other product or packages provided by the service provider.
3. SEVAMRUTAM users cannot put the paid service on hold even temporarily, for any reason whatsoever. Based on the tenure of paid service and date of payment taken.
4. After validity of your plan automatically discontinued and if you required to extend the same service, members can renew plan with existing plan amount at time of renewal.
After availing our services and if you opt for chargeback, we will have the right to suspend your profile and take action against you as we deem fit without any notice to you.

Jurisdiction and Applicable Law

The registration of users and all SEVAMRUTAM services are deemed to have been entered into within the territorial Jurisdiction of, India.

Privacy Policy :

Protecting your private information is our priority. This Statement of Privacy applies to SEVAMRUTAM a temple seva management applications data collection and usage. The SEVAMRUTAM a website/app is a service that accepts and sends emails (the “Service”). By using the SEVAMRUTAM Application, you consent to the data practices described in this statement.

Collection of your Personal Information

“SEVAMRUTAM” collects and stores personal information, such as name and email address. If you Register SEVAMRUTAM App, we collect, but do not store, billing and credit card information solely for the purpose of completing the purchase transaction. We may gather additional personal or non-personal information that you may provide to us in the future. Information about computer hardware and software may be automatically collected by SEVAMRUTAM. This information can include: your IP address, browser type, domain names, and access times. This information is used for the operation of the service, to maintain quality of the service, and to provide general statistics regarding use of the SEVAMRUTAM.

SEVAMRUTAM collects, stores and uses your personal information to operate the Application and get result to your expectations. SEVAMRUTAM does not sell, rent or lease its customer lists to third parties. SEVAMRUTAM may share data with trusted partners to help perform research and statistical analysis, to facilitate email communications or to provide customer support. All such third parties are prohibited from using your personal information except to provide these services to SEVAMRUTAM, and they are required to maintain the confidentiality of your information. SEVAMRUTAM will disclose your personal information, without notice, only if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on SEVAMRUTAM; (b) protect and defend the rights; and, (c) protect the personal safety of users/members of SEVAMRUTAM.

Security of your Personal Information
SEVAMRUTAM secures your personal information from unauthorized access. When sensitive personal information (such as a credit card number) is transmitted to other websites, it is protected through the use of encryption, such as the Secure Sockets Layer (SSL) protocol.

Data & Account Deletion

User can request to delete the profile or account by writing us an email mentioning the registered mobile number and the reason for profile / account deletion to info@saraghsoft.com, our support team will review the request and delete the same.
Moreover, SEVAMRUTAM keeps the registered mobile number and email of the deleted account to validate at the time of re-registering using the same mobile or email ID.

Changes to this Statement

SEVAMRUTAM will occasionally update this Statement of Privacy to reflect company and users feedback. SEVAMRUTAM encourages you to periodically review this Statement to be informed of how it is protecting your information.
